Terms and Conditions

BOOKING AND DEPOSIT
Before a booking can be accepted a member of the party must complete and sign the booking form as indicated.  The signatory, who must be 25 years or older, shall then be deemed as the agent for all persons shown on the form.  Your booking is confirmed and guaranteed when a deposit of £125/$250 per booked week (or part week) is paid. This deposit is non-refundable.

PAYMENT OF BALANCE
Full payment must be received at least 10 weeks prior to arrival date.  Failure to make payment within the specified period will entitle us to cancel the booking and claim the appropriate cancellation charges.

SECURITY DEPOSIT
You and your party are responsible for any breakages or damage caused to the rental property.  A security deposit of £150/$300 is required to be paid one month prior to your arrival date.  After completion of the rental period, the property will be inspected and the security deposit refunded within 28 days if no breakages or damage are found.  Claims on the security deposit may include but are not limited to, additional cleaning costs for removal of stains, excessive use of electricity or water (typically caused by leaving doors open whilst air conditioning is running or using water hose as play thing) and loss of key.

IF YOU CANCEL YOUR BOOKING
If you or any member of your party wishes to cancel the whole or part of the booking once it has been confirmed, we must be informed in writing. The following cancellation charges will apply:
More than 10 weeks till arrival date  – Loss of deposit only.
Less than 10 weeks till arrival date – Loss of total rental charge.

IF WE CANCEL YOUR BOOKING
We reserve the right to refuse admission or remove guests from the property, without compensation, who do not comply with our booking conditions and whilst on the premises
• Do not vacate the property at the checkout time unless an extension of time has been previously agreed in writing
• Indulge in bad language, misconduct or disturb the peace and comfort of neighbouring homes
• Are intoxicated
• Illegally possess or deal in controlled substances
• Refusal of admission or removal from the property shall not be based upon race, creed, colour, sex, physical disability or natural origin.
In the unlikely event that the property becomes unavailable for any reason we will make every effort to locate alternative accommodation for you.  However, in any event, our maximum liability to you is limited to the refund of the rental amount paid, less rental days used.

OCCUPANCY

Only those persons named on the Booking Form are permitted residency for all or part of the rental period. Guests are permitted a maximum of 8 visitors at any one time. These visitors, however, are not permitted to stay overnight. Any persons occupying the home overnight and not shown on the booking form will cause the whole party to be excluded from the property without refund.
Failure to comply with the above occupancy restrictions will also result in the forfeiture of the full security deposit.

NAME OR NUMBER CHANGES TO PARTY MEMBERS
Any amendments to names or number in party made after the booking form has been received by us must be notified in writing.

VEHICLES/PARKING
Vehicles and any associated trailers must only be parked in the driveway at the front of the property. At no time should any vehicle or trailer be parked on the lawns adjacent to the property.
To satisfy many requests from guests the garage has been converted to a games room, therefore this area must not be used for the storage or parking of vehicles at any time. Failure to comply will result in the loss of full security deposit.

TRAVEL AND HEALTH INSURANCE

Guests are advised to have appropriate travel/medical insurance for both the period of rental and their entire holiday.  All matters arising with regard to loss or injury should be directed to the respective insurance company.

SWIMMING POOL
The swimming pool is a facility for which you are not charged; only the heating of the pool is charged. When the pool water is heated the blue cover should be in place when the pool is not in use to ensure the water remains heated. Guests are specifically requested not to allow unsupervised children to use the pool or to cover/uncover the pool.   If you have requested and paid for pool heating and the heater malfunctions you will be refunded pro rata.  Please understand that during winter months the heater will generally not be able to attain as high temperatures as it would in warmer months of the year.  However if the air temperature drops below 50 degrees Fahrenheit then the low temperature protection circuits will disable the heater to prevent possible damage to the compressor.  In these circumstances a refund of part, or all, of the supplement paid is not possible and your understanding of this important matter is an essential part of this reservation. The Owners do not accept any liability for any injury however caused as a result of the use of the pool.

INTERNET
FREE broadband internet is provided for guests during their stay. Whilst every effort is made by the owners to ensure this service is available for use, they cannot be held responsible for any failures or non availability of communication lines, hardware or software.

SPECIAL CONDITIONS
The Owner, the Management Company and their respective agents accept no responsibility for, and shall not be liable in respect of loss, damage or injury caused by force majeure.  These include but are not limited to, war, acts of terrorism, riots, strikes or other industrial action, airport closures, fire, flood, other weather conditions or any event beyond their control.

PERSONAL SAFETY

The Owners cannot accept any liability for your personal safety during your stay.  Guests are reminded to exercise care as to the personal safety of themselves and all party members.  Whenever possible, valuables should be left secure and out of sight.  It is the guest's responsibility to exercise a duty of care at all times and party leaders should ensure that all their party follow the comprehensive operational and safety instructions relating to the use of facilities and equipment, familiarise themselves with the fire procedure displayed in the home and confirm all persons in their party are adequately covered by appropriate personal theft/accident/injury/public liability insurance.

SMOKING
Smoking is not permitted anywhere inside the property.  Smokers are welcome to smoke in the garden and pool area only. If this rule is not adhered to, then your security deposit will be withheld in full and you will also be excluded from the property without recompense of rental paid

PETS

Due to allergies of the owners and to ensure the comfort of all of all guests, pets are not permitted. If a pet is found at the property, no matter for how short a time, then your security deposit will be withheld in full and you will also be excluded from the property without recompense of rental paid.

INSECTS

Florida is a tropical state and as such insects and small creatures are inevitable and are not a cause for complaint.  Their presence is no reflection on the cleanliness of the property.  The rental property is treated regularly as part of a pest control program.  Keep all windows and external doors closed whenever possible. This will help keep bugs from the property and also enable the air conditioning unit to function more efficiently.

PROBLEMS OR COMPLAINTS

In the very unlikely event that you experience any problems with the rental property you must, in the first instance, contact our local Management Company who will do their best to assist and rectify the matter as soon as is practically possible.  Should a problem remain unresolved the Owners must be notified as soon as possible. 
Every effort has been made to ensure the accuracy of descriptions concerning the rental property and services. However, we cannot be held responsible for any errors, omissions and/or changes beyond our control.

LAW
This contract is subject to and shall be constructed in accordance with the laws of Scotland and the parties hereby submit to the exclusive jurisdiction of the Scottish courts.
